Fees - You Really don't need to pay high fees to a Lawyer to get a Patent - A Patent Agent may be better.
The topic of fees is difficult since every case varies in
complexity. People always call and ask how much it will cost to have a patent application
prepared on their invention, but they do not want to say what their invention is !
This puts me in the extremely difficult situation, since I have no knowledge of how much
time will be involved in writing it. (Writing an application on a toaster oven takes
more time and effort than a back pillow.) Therefore, I cannot give an estimate
which is fair to both of us. Suffice it to say that in most cases a patent
application written could be prepared by us for about $ 1800. About 60 % of the inventions
I encounter fall within this category. For more complex inventions, preparation of the
application will take more time and effort and more compensation will accordingly be
required. Regardless, you will save thousands, since the going rate
for many other patent professional, and especially unscrupulous lawyers, is often over $
4000.
You can find this out from the US Patent Office free Search Page by clicking HERE. All you have to do is enter the name of the patent lawyer, patent agent, or firm whom you are considering hiring in the data input field box, and click on the "Search" button. Patents written by the particular lawyer, agent, or firm you are considering will show up, and you can read through them to evaluate the abilities of the individual. You can also get the name and city and state of the Client (inventor information is printed on the front page of the patent) !!! A $1.00 call to directory assistance in their city 1-(area code)-555-1212 will get you their phone number in most cases. Ask the inventor questions like "Did the person you hired charge you more than they said they would ?" or "Were they timely ?", "Would you use them again?" The information you learn could save you a fortune and many headaches.
Then ask anyone who has hired us.
Be especially wary of individuals who claim to have "written" hundreds of patent applications, but have fewer than five actually issue as patents !!!!!!!! Also, if someone advertises a fee, look for a little asterisk * near it, and fine print at the bottom of the page. Typically, the fine print says that the fee cited is a baseline fee and your costs "may" be more. What good is this, except as a bait and switch ???? I give estimates from which I do not deviate.
I hope this has helped. If you have any trouble with this type of search, feel free to email or call and I'll be happy to aid you in using the US Patent Office's free Search Page.
